Terms and Conditions

The following terms and conditions constitute a legally binding contract (this "Agreement") between you (“you” or “your”) and Custom Hut LLC, a Nevada limited liability company doing business as POD Hut (hereinafter “POD Hut”), that governs all use by you of the POD Hut website (the "Site") and the services available on or at the Site (taken together with the use of the Site, the "Services"). We’ll refer to POD Hut and all of its subsidiaries and affiliated companies collectively as "POD Hut," "we," "our," "us," etc. POD Hut is a print-on-demand company that specializes in serving businesses looking to outsource printing and fulfillment, with a focus on streetwear but catering to a variety of niches. POD Hut prints and dropships products ("Products") directly to you and your customers ("Customers").

The Services are offered subject to your acceptance without modification of all of the terms and conditions contained herein. We also have other policies and procedures including, without limitation, Shipping, Return Policy, Privacy Policy, and others. Those policies contain additional terms and conditions, which apply to the Services and are part of this Agreement. Your use of the Site constitutes your acceptance of and agreement to be bound by this Agreement. By signing up as a member, you explicitly agree to these terms and conditions. Furthermore, by placing an order for products or services from the Site, you accept and are bound by this Agreement. If you do not agree to this Agreement, do not use the Site or any other Services.

If you use our Services only for your personal use, you are considered a "User." If you use our Services to execute orders or deliver Products to third parties (including Customers), you are considered a "Merchant."

REGARDLESS IF YOU ARE A USER OR MERCHANT, SECTION 18 OF THIS AGREEMENT REQUIRES THAT ALL DISPUTES ARISING FROM OR RELATING TO THIS AGREEMENT BE SENT TO MEDIATION AND, IF NOT RESOLVED IN MEDIATION, BE RESOLVED BY ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY JURY TRIAL OR CLASS ACTIONS.

1. Access & Membership
To enjoy all of POD Hut’s benefits, you may register an account and become a member ("Member"). Membership requires that you register on the Site (including truthfully filling out all required personal information). By completing the registration process, you confirm your agreement to these terms and conditions. You may opt out of marketing and promotional activities, including emails. You may cancel your membership at any time by canceling it online on the Site. To complete registration, you must provide your name, email address, and password. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. Notify POD Hut immediately of any breach of security or unauthorized use of your account.

POD Hut may change, suspend, or discontinue the Services, Products, fees, charges, or terms at any time. Changes will not affect confirmed orders. POD Hut reserves the right to limit access to certain features and Services or restrict access entirely without prior notice or liability.

2. Modifications
POD Hut reserves the right to modify this Agreement and its terms, as well as fees and charges for Services, at any time. Changes become effective immediately upon posting. You agree to review this Agreement periodically. Continued use of the Site constitutes acceptance of any modifications. If you do not agree to the updated terms, you must discontinue using the Services.

3. Use of Services
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services subject to this Agreement. You agree to:

Not use the Services unlawfully, including but not limited to violating intellectual property rights, engaging in fraud, or infringing on privacy laws.

Not harm our systems, including introducing harmful code, disrupting Services, or accessing restricted areas without authorization.

Follow brand guidelines, which govern the appropriate use of POD Hut’s trademarks, logos, and branding.

Respect intellectual property laws when using digital assets or services provided by POD Hut.

4. Shipping
Shipping costs vary by item, location, and other factors. Once an order is confirmed, it may not be possible to edit or cancel it. POD Hut transfers risk of loss to you or your customer upon delivery of the Product to the carrier. Claims for lost or damaged items must be filed in compliance with POD Hut’s Return Policy.

5. Payments and Fees
You must pay for orders in advance. Payments can be made via credit/debit card, PayPal, or other accepted methods. Subscription fees (if applicable) are non-refundable, and failure to pay may result in suspension or termination of your account.

6. Limited Warranty on Products
POD Hut warrants that Products will be free of material defects at the time of delivery. Claims for defective or damaged Products must be submitted within 30 days of delivery. Remedies include replacement of the Product or a refund, at POD Hut’s discretion.

7. Governing Law
This Agreement is governed by the laws of the State of Nevada, without regard to its conflict of laws rules.
